Massachusetts is the only state in the US with a complete ban on consumer fireworks, including sparklers and firecrackers. This ban has been in place since 1943, with residents unable to possess, sell or use them. However, since then, Delaware, New Jersey, and New York have relaxed restrictions.
In 2014, Massachusetts was one of four states in the Northeast with full bans on fireworks. However, since then Delaware now allows ground-based fireworks and handheld sparklers on July 4th and New Year’s Eve while New Jersey permits handheld sparklers and novelty items for those 16 and older.
Despite this relaxation of restrictions in other states, officials in Massachusetts continue to enforce the ban on fireworks. Anyone caught with illegal fireworks may face fines, with police required to confiscate them. Fire departments in Massachusetts have reported numerous fires, burns and injuries related to illegal fireworks between 2013 and 2022. In 2022 alone there were 106 fires, 38 injuries and over $400,000 in damages attributed to fireworks. The Department of Fire Services and State Police have emphasized the dangers of illegal fireworks especially during the week of July 4th. Residents are encouraged to attend professional fireworks displays as an alternative way to enjoy the holiday festivities safely without putting themselves or others at risk.
