Squishmallows initiates legal battle with Build-A-Bear

A legal battle over a copyright issue is brewing between two popular plush toy companies, Squishmallows from Jazwares and Skoosherz from Build-A-Bear Workshop. The dispute centers on the similarity of Skoosherz to Jazwares’ egg-shaped cushion animals. Both companies are taking their grievances to court, with Jazwares suing Build-A-Bear in California for intellectual property infringement and Build-A-Bear launching a lawsuit against Jazwares in Missouri.

Jazwares owner believes that Skoosherz is a knockoff of their Squishmallows and has been selling the toys since 2017. Meanwhile, Build-A-Bear claims that Skoosherz is simply their own version of a popular type of toy. The range of Squishmallows animals originally included a fox, cat, and frog but has since expanded to over 1,000 different versions due to its popularity during the pandemic when people bought comforting items for their homes. It went viral on TikTok and was endorsed by celebrities.

In addition to this legal dispute, Jazwares has also filed a lawsuit against Chinese online retailer Alibaba for allegedly selling counterfeit toys. Their lawyer stated that imitation is not the sincerest form of flattery when it comes to intellectual property rights. On the other hand, Build-A-Bear has not yet responded to the request for comment regarding the lawsuit.
